23XI and FRM release a strong response against Nascar in their legal battle


23xi racing and first -row engines fired on a response to Hind On Tuesday (September 2) in the ongoing legal battle between the parties. The latest development comes from the Preliminary Preliminary High Court, where teams try to annul their refusal to retain their letters for the rest of the 2025 Cup season.

The informed of Motorsports, Jeff Gluck, has been covering the last developments in the court battle between the sanctioning body of the sport and the two race teams. In the response, 23XI and FRM stated several applications to make the preliminary order disappear until the legal battle was resolved.

Gluck reported that the teams requested Nascar not to change the rules, allowing teams to compete for the rest of the 2025 season, not transfer any of the six cards until the case reached a resolution, it agrees that the teams have the cards, they do not broadcast, they sell or transfer a letter for the rest of the season and they do not sell or transfer more than four letters for 2026.

Gluck then added a statement to his long x post on the answer, writing:

“Anyway, the teams say that the Nascar” refused to make any changes in their commitments and representations, which left the plaintiffs without any other option than to maintain their motion in preliminary order to try to preserve the status quo through the judgment. “”

Here is what the teams offered to make the request for preliminary ordering:– NASCAR will not change the rule that allows teams to do each race for the rest of this year (Nascar already said in their warning on Friday)– NASCAR will not transfer any of the previous six letters until the case is resolved– NASCAR will agree that the teams are the owners of the two disputed shr cards and will not try to get rid of the sale of those and sell them to someone else until the case is resolved– NASCAR will not broadcast/will sell/transfer a letter this season (Nascar already offered it in their warning on Friday)– Nascar will not sell/will transfer more than four letters for 2026 (Nascar already offered it on Friday), which in theory would allow teams to recover their six if they won. And there were some stipulations with this, such as the teams that retained their rights over their history related to performance, etc.

The ongoing legal battle that Nascar against 23XI and FRM began when the two teams did not reach a chartered agreement before the 2025 season. The teams filed a lawsuit against the Nascar, accusing the sport of monopolist practices and for violating Sherman's antimonopoly law. As neither party reaches the agreement, Gluck said he could be in the hands of a judge.

“Again, there is not much discomfort here. The judge did not want to have to govern on this, but both parties put him in a place where he now has to do it,” Jeff Gluck wrote.

Nascar set the second Playoff race on the 2025 Cup on Sunday
